As you read my initiatives below, understand that I am not advocating for the removal of penalties. I am, however, advocating for more intelligent penalties.
My priorities are, in order:
1. Remove violent or habitual criminals from society.
2. Increase true restitution for victims.
3. Maximize outcomes for society by deterring new crime and rehabilitating offenders.
The question is, when they re-enter society, how can we maximize positive outcomes for society?
- How can we ensure they are drug-free when they leave?
- How can we ensure they are more literate?
- How can we ensure they are more mentally stable?
- How can we ensure that, if they have families, they can support their families and not add countless Utahns to welfare rolls?
I will sign an Executive Order mandating all rape kits have processing begin within 24 hours of collection, and completed within 7 calendar days.
Utahns believe their neighbors are innocent until proven guilty and that no one should have their reputation tarnished unless there is proof of guilt in a court of law.
I will sign an Executive Order banning the publishing of any mugshots unless a prosecutor can prove to a judge that the accused is likely to have additional, unidentified victims.
You are innocent until proven guilty.
You shouldn't have to pay your way out of jail before you are convicted.
I will sign an Executive Order banning cash bail for any non-violent or non-sexual assault crime, or unless specifically ordered by a judge.
Prosecutors will not be allowed to request bail unless the suspect is being charged with a violent crime, sexual assault, or stalking allegation.
If judges believe suspects are a flight risk, they will be able to order electronic monitoring.
Unless arrested for a violent, sexual, or stalking crime, I will introduce a bill to mandate same-day processing of suspects of other crimes.
No other Utahn should risk losing their job because they must spend a night in jail for a crime for which they’ve not yet been convicted.
Utah needs to stop spending so much money jailing people before they have had their day in court.
Except for cases of violent crime and/or sexual assault, I will sign an Executive Order expunging records of any juvenile misdemeanors, upon the juvenile reaching age 18, and completing at least 100 hours of community service, and earning a high school diploma or GED.
I will also require, if the victim agrees to participate, that all juveniles convicted of crimes to participate in "Restorative Justice," facing their victims in a controlled setting. This process has shown tremendous efficacy and meaningfully reduces repeat offenses.
The Death Penalty is costing Utah millions of dollars each year. It is time to end the practice.
I will sign an Executive Order staying the executions of all death row inmates, effectively converting them to life without parole.
I will sign an Executive Order banning any registered sex offender from residing within 2000 yards of a school.
I will introduce a bill to ban the use of any confession unless it has been obtained in the presence of counsel, and memorialized on video.
I will introduce a bill banning the interrogation of any juvenile without counsel present.
For non-violent, non-sexual, and non-stalking crimes, I would look to reduce the sentences of Utah's current 7,000 prisoners by 20%.
If you are sentenced to 5 years, you can learn just as much in 4 years.
By reducing sentences of non-violent, non-sexual and non-stalking prisoners by 20%, Utah would save $30-50 million dollars per year.
I will introduce measures to encourage as much prisoner/family contact as possible. Prisoners need to be reminded of why they need to change their lives. Isolation from family only makes things worse.
I will introduce measures to increase "Restorative Justice" reconciliation meetings between prisoners and their victims. Studies show that when an offender learns in person how they impacted the victim, repeat offenses plummet.
